TRI Industry Sector Scope

Section 313 of EPCRA originally established the TRI Program to require reporting from a specific set of sectors. EPA is currently considering adding several additional sectors to the scope of the TRI program and is interested in gathering public input regarding this potential action. Are there sectors you think should be added in the future to further enhance the scope of the TRI program?

Phosphate Mining

EPA is considering the addition of facilities classified under NAICS 212392 (Phosphate Rock Mining) to the list of facilities subject to EPCRA § 313.

Iron Ore Mining

EPA is considering the addition of facilities classified in NAICS 212210 (Iron Ore Mining) to the list of facilities subject to EPCRA § 313.

Solid Waste Combustors and Incinerators

TRI coverage of NAICS 562213 (Solid Waste Combustors and Incinerators) is currently limited to facilities regulated under subtitle C of the Resource Conservation and Recovery Act (RCRA). EPA is considering removing that limitation with this rule.

Large Dry Cleaning Facilities

EPA is considering the addition of large dry cleaning facilities to the list of facilities subject to EPCRA § 313. Large dry cleaning facilities commonly use the TRI-listed chemical perchloroethylene (PCE) in significant quantities.

Bulk Petroleum Storage

EPA is considering expanding current TRI coverage of bulk petroleum facilities to include bulk petroleum storage facilities and bulk petroleum stations and terminals for hire, classified under SIC 4226 (Special Warehousing and Storage, Not Elsewhere Classified) and the corresponding NAICS 493190 (Other Warehousing and Storage).

Steam Generating Facilities

Current TRI coverage of NAICS 221330 (Steam and Air-Conditioning Supply) is limited to facilities that generate a combination of electric, gas, and other services (e.g., facilities that cogenerate steam and electricity). EPA is considering expanding TRI coverage of NAICS 221330 to include facilities that combust coal and/or oil for the purpose of generating steam for distribution in commerce.
